Data consulted on 10/03/2026.
Basis
- Law No. 12.651/2012 (Planalto, in Portuguese): art. 35, § 1º, establishes that planting or reforestation with native or exotic forest species does not require prior authorization, but must be reported to the competent authority within 1 year for origin control purposes.
How it applies
The 1-year deadline to inform the competent authority about planting or reforestation with native or exotic forest species is mandatory and must be complied with by the owner or possessor of the land. The information is necessary for controlling the origin of forest products, as established in the National System for Controlling the Origin of Forest Products (Sisnama).
Limits
- The obligation to report does not apply to Permanent Preservation Areas (PPA) or Legal Reserves that are already properly registered in the Rural Environmental Registry (CAR) and in compliance with the legislation.
- The deadline does not apply to cutting or exploiting native species planted in alternative soil use areas, provided that the planting or reforestation is previously registered with the competent environmental authority and the exploitation is declared for origin control purposes (art. 35, § 3º).
- Law 12.651/2012 was amended by Law 12.727/2012 and MP 571/2012, which consolidated the current wording of § 1º of art. 35. Subsequent changes must be verified directly from the official Planalto source.
