Basis
- Law No. 14.457/2022 (Planalto, in Portuguese): art. 8, § 1, establishes that flexibility measures (part-time, time bank, vacation advance, flexible hours) may be adopted until the second year of the birth, adoption, or custody of a child aged 6 or under or with disabilities.
How it applies
Work schedule flexibility measures (part-time, time bank, vacation advance, flexible hours) are applicable for up to 2 years after the birth, adoption, or judicial custody of a child aged 6 or under or with disabilities. Granting depends on individual, collective, or union agreement, and must be formalized with the expressed will of the employee.
Limits
- The 2-year deadline applies only to the measures listed in art. 8 (part-time, time bank, vacation advance, flexible hours) and not to other flexibilities not provided for in the law.
- Flexibility does not extend beyond the second year after the event (birth, adoption, or custody), even if the child is still under 6 or has disabilities.
- Measures must be formalized by individual, collective, or union agreement, as per § 2 of art. 8.
- The law does not cover situations of non-judicial temporary custody or international adoption not regulated in Brazil.
