Basis
- Law No. 14.120/2021 (Planalto, in Portuguese): Article 5º-B states that unallocated CDE (Energy Development Account) resources must be allocated to tariff affordability by 31/12/2025, except for resources already allocated by 01/09/2020 or rejected projects.
How it applies
The rule applies to unallocated resources for projects contracted or initiated by August 31, 2020, as per Article 5º-B of Law 14.120/2021. Allocation to tariff affordability is mandatory by December 31, 2025, except for resources already linked to projects initiated or contracted before that date.
Limits
- The rule does not apply to resources already allocated to projects contracted or initiated by 01/09/2020, as per § 2º of art. 5º-B.
- Resource allocation must observe a minimum limit of 70% of the total available amount, as per § 1º of art. 5º-B.
- Allocation to tariff affordability is subject to ANEEL regulation.
